What Is a Lookback Period?

A lookback period, also known as a “cleansing” period, is the amount of time a prior DWI conviction can be considered in the sentencing for a subsequent conviction. In Louisiana, misdemeanor DWI offenses have a lookback period of ten years. This means a second DWI offense occurring more than ten years after a first offense will be treated the same as the first offense for sentencing purposes. Note that this is not the same as expungement, which in Louisiana is available for misdemeanor DWI convictions after five years, subject to a few exceptions a criminal defense attorney can explain.

What Are the Penalties for a Second DWI?

A second conviction carries with it a mandatory 48 hours in jail and possibly up to six months in prison. In addition to paying for the court fees, the fine could be as high as $1,000. The Louisiana DMV will also impose a one-year license suspension on the offender.

What Are the Penalties for a Third or Fourth DWI?

A third DWI offense within a ten-year period is considered a felony. That means a minimum of a year in prison with the possibility of up to five years. The fine is up to $2,000 plus court costs. A fourth offense should be avoided at all costs, as it could result in up to thirty years in prison.
