Theft in Louisiana vs. Other States

Charges of theft are classified differently in Louisiana than they are in the majority of other states. Unlike most states, which divide theft offenses into several categories (often Class A, B, and C), taking anything that belongs to another person is considered theft in Louisiana. In addition, crimes are not labeled either a felony or a misdemeanor based on severity, as they are in other states. Any crime that could be punished with imprisonment or death is technically a felony in Louisiana, which includes any type of theft. Louisiana Theft Penalties

Theft convictions in Louisiana are penalized as follows:

  • Imprisonment up to six months and/or a fine of up to $1,000 for theft of property valued at less than $500
  • Imprisonment of up to five years and/or a fine of up to $2,000 for theft of property valued between $500 and $1,500
  • Imprisonment of up to 10 years and/or a fine of up to $3,000 for theft of property valued at more than $1,500

Stealing from a merchant or store also carries a civil penalty of between $50 and $500, plus the full value of the stolen goods if they are not returned in sellable condition.

Additional Circumstances

Theft of items valued at less than $500 carries even more severe penalties for those with two or more prior theft convictions. These individuals can be imprisoned for up to two years and may be ordered to pay a fine of up to $2,000.

If a firearm was involved in the theft, the offender will receive a mandatory sentence of two to ten years, along with a fine of up to $2,000. This penalty applies even if the person has no prior convictions. If he or she does have prior convictions, the mandatory penalty increases to a prison sentence of five to 15 years.

Increased penalties may also apply for specific categories of theft. These include, but are not limited to, theft of animals, credit cards, petroleum products, utility services, oil and gas equipment, firearms, identity, and motor vehicles.
